Privacy Notice for Candidates - Career at Daiichi Sankyo

Daiichi Sankyo is committed to protecting personal data. We process personal data in accordance with applicable legal requirements.

This Privacy Notice explains which types of personal data Daiichi Sankyo Co., Ltd., based in Tokyo and its affiliated companies ("Affiliates"; together with Daiichi Sankyo Co., Ltd "Daiichi Sankyo" or "we") collect from job applicants in the course of their application for open positions at Daiichi Sankyo and those registering for our talent community (“you”), how personal data is being processed, and which rights you have in this regard.

1. For which purposes and on which legal bases will my data be processed?

a. Job application
Through the "Daiichi Sankyo Career Portal” (“Career Portal”), we offer you the opportunity to apply online for a specific job advertised by Daiichi Sankyo.

Any personal data you provide (including any data resulting from any attachments you provide) will be processed and used by Daiichi Sankyo for global personnel recruitment, management and planning purposes. This includes but is not limited to processing your application, assessing your skills, qualifications, and suitability for the vacant position, carrying out reference checks, where applicable, communicating with you about the recruitment process, keeping records related to our hiring processes, exercising or defending against legal claims or complying with legal or regulatory requirements. As part of the required registration, you will create an applicant profile, which you can view and also update or delete online using the access data you have provided.

If you decide to apply for a specific job, the processing of your data is based on the necessity of the processing for the potential establishment of an employment relationship with you. To the extent that we keep your data for a limited period of time after your application, we do so based on our legitimate interests to establish, exercise and defend our legal claims.

In addition, to the extent necessary in connection with the implementation of certain measures for pre[1]employment compliance checks, we may separately ask for your prior consent before processing your personal data. You are free to refuse your consent. However, if necessary, we may ask you in this case for further evidence enabling us to perform a full pre-employment compliance check.

If you are hired, personal data collected during your application process may be integrated into our global human resources systems and used to facilitate your onboarding. This information may also be added to your employee file and utilized for other employment-related purposes in compliance with applicable laws and company policies. In this context, processing of your data is based on the necessity to manage our employment relationship with you.

b. Talent community
On our website, you have the option to create a profile and join our talent community. This provides you with the opportunity to identify professional opportunities at Daiichi Sankyo that may be of interest to you. We may review your profile and, provided you have given your consent, contact you regarding potential career opportunities. We process only personal data that you share with us during the registration process or when you update your profile.

The processing of your personal data for this purpose is based on our legitimate interests in providing the talent community services you actively requested by joining and maintaining your profile, as well as reviewing your profile and, provided you have given your consent, contacting you about potential career opportunities that match your skills and experience.

c. Newsletter about career opportunities and notifications for new job postings
When you create a profile for the Career Portal or talent community on our website, you can provide your consent to receive newsletters about career opportunities at Daiichi Sankyo, Daiichi Sankyo’s company culture, and other related organizational news. In addition, you can consent to receive notifications when new job positions that match with your preferences or profile become available, allowing you to stay informed about potential career opportunities at Daiichi Sankyo. Based on your consent, we will use the personal data from your profile to contact you by email to provide you with the relevant newsletters and/or job-related notifications.

d. Improving Human Resources Operations and Services
We may use your personal data to assess and enhance the effectiveness of our HR operations, processes, and related services based on our legitimate interests.

2. Which of my data will be processed?

a. Data that you disclose to us
When you create a profile for the Career Portal or talent community, you provide us with certain personal data, which we use for the purposes described above. If you choose not to provide the respective data, we may not be able to assess your eligibility for vacancies. Please make sure that the data you provide is correct and true.

Depending on the country-specific characteristics and the specific job position, we may process the following Information:

- name, date of birth, address, country of residence,

- email address and phone number,

- information related to your work history and experience, such as present or former employers,

- information related to your education, qualification and skills,

- application documents you provide (CV, resume, reference letters etc.),

- salary expectations,

- any other information which you share with us through the application process,

- username, password to access your profile, IP address and device identifiers that may be automatically collected

In addition to the information above, further relevant personal data may be requested during the application process. These may differ in scope and nature depending on the specific job position you apply for.

When you sign up for the newsletter about career opportunities and/or notifications for new job postings, we will process your email address and the information in your profile to provide you with the newsletters and/or notifications that match with your preferences or profile.

b. If you are already an employee of Daiichi Sankyo
In case you are already an employee of Daiichi Sankyo we may also process data that we have collected in the context of your employment such as the start date of your employment and your current department.

c. Data that we collect from other sources
We may also obtain your personal data from recruitment agencies with which we cooperate, as well as from our employees who recommend you as a candidate for a specific job opening through our Referral Program. In addition, we may collect data from you that you have published via job application platforms as well as via publicly accessible and professionally used social media for maintaining existing and making new business contacts (e.g. LinkedIn, Xing). This includes your name, contact details, career details and other relevant data that you may disclose in the respective network for professional purposes. In addition, in certain cases, we may receive relevant personal data from risk management service providers which supports us – to the extent necessary and legally permitted – in carrying out a pre-employment compliance check of your suitability for the desired position (e.g., verification of your information on reported address, relevant (highest) educational qualifications and, if applicable, financial circumstances (if relevant for recruitment to the specific position), screening against relevant sanctions, terror and negative lists).

3. Is there automated individual decision-making or “profiling”?
We do not use automated processing or decision-making processes to recruit job applicants or establish employment.

4. To whom will my data be disclosed?
Daiichi Sankyo is an international organization with a global presence. Accordingly, your data may be processed and shared with Daiichi Sankyo's group of companies within Daiichi Sankyo's global operations for recruitment, management, and planning purposes. This processing is carried out based on our legitimate interests in identifying, evaluating, and managing talent to support our global business operations, while ensuring that appropriate safeguards are in place to protect your rights and personal data in accordance with applicable data protection laws. Within Daiichi Sankyo, Daiichi Sankyo Co., Ltd as the parent company is responsible for operating the Daiichi Sankyo Career Portal. If you apply through the Daiichi Sankyo Career Portal for a position with Affiliates or join our talent community, your data will be disclosed to the Affiliates that are involved to evaluate the qualifications and suitability as well as to conduct interviews. To this extent, Daiichi Sankyo Co., Ltd and the respective Affiliate will be jointly responsible for your data. To effectively exercise your rights as a data subject, you may contact the designated central contact at any time. You are of course free to exercise your rights also directly against the respective Affiliate.

In addition, to the extent legally permitted, we transfer your personal data to external service providers in the areas of IT services (such as technical service providers for storing your data) and compliance review who have been carefully selected in advance and are contractually bound in accordance with applicable data protection legislation. These companies may only process your personal data on our behalf to the extent necessary to provide the services we have contracted them to provide. Your data will not be sold to third parties or marketed in any other way.

We will disclose your personal data to other data controllers only if necessary and permitted by applicable law. Daiichi Sankyo may disclose your information to third parties, including public authorities, courts or law enforcement agencies, when obligated or permitted to do so by law and in order to investigate, prevent, or take action regarding suspected, or actual unlawful activities, including but not limited to fraud and situations involving potential threats to the physical safety of any person, to comply with legal obligations (e.g. tax authorities), to support internal or external audits, to establish or exercise our legal rights or to defend the rights, property, or safety of our organization or others.

5. International Data Transfers
Whenever we transfer your personal data beyond the country/region of origin, we will do so in accordance with applicable laws. For example, if we transfer your personal data from the EEA, Switzerland or the UK to a country that does not provide a level of protection equivalent to that of the originating jurisdiction, we ensure appropriate data protection measures are implemented. These may include the use of EU Standard Contractual Clauses (SCCs), with necessary adaptions for the UK and Switzerland, and the application of supplementary measures where necessary. For more information on the recipients of your data, the affected third countries and the measures implemented to protect your data, and to receive a copy of these measures, please contact Daiichi Sankyo at the contact details referenced in Section 8.

6. How long will my data be stored?
In principle, personal data in your profile will be stored for up to six (6) months of inactivity after your last login at the Daiichi Sankyo Career Portal or talent community. This period is extended with each login. You can also delete your profile yourself by selecting the buttons shown in the account settings. Note: If you delete your profile, any submitted and ongoing applications will be withdrawn and subsequently deleted.

For Affiliates in the following countries, different retention periods apply:

We will generally delete your data after expiry of the retention period as specified above, unless the deletion is in contradiction to our statutory retention obligations, or any further storage is necessary in the specific case to fulfil other legal obligations or to protect our legitimate interests (establishment, exercise or defence of our legal claims).

7. Which rights do I have and how can I exercise them?
You have the right, subject to and in accordance with applicable law:

  • to obtain information on your personal data processed and to obtain a copy of such data (right of access);
  • to obtain the rectification of any inaccurate data and, having regard to the purposes of the processing, the completion of incomplete data (right to rectification); please let us know if and to what extent your data stored by us has changed, so that we can rectify or update the respective data;
  • if there are legitimate reasons, to request the deletion of your data (right to erasure);
  • to request the restriction of the processing of your data, if the legal requirements are met (right to restriction of processing);
  • if the legal requirements are met, to receive the data provided by you in a structured, commonly used and machine-readable format and to transfer this data to another controller or, if technically feasible, to have it transferred by us (right to data portability); and
  • not to be subject to a decision based solely on automated processing which produces legal effects concerning you or significantly affects you in a similar way, if the legal requirements are not met. As noted above, Daiichi Sankyo does not utilize an automated decision-making process

You also have the right to object, in accordance with the statutory provisions, to the processing of your data, which is necessary for the purposes of our or a third party’s legitimate interests, on grounds relating to your particular situation (right to object).

If the data processing is based on consent, you can withdraw the consent at any time. The withdrawal of your consent does not affect the lawfulness of the processing of your data until withdrawal.

In order to exercise your rights, including the withdrawal of your consent, please contact Daiichi Sankyo using the information provided in Section 8.

Without prejudice to any other remedies, you also have the right to lodge a complaint with a supervisory authority at any time.

If you apply for a job position at Daiichi Sankyo in the European Economic Area, Switzerland or United Kingdom, Daiichi Sankyo Co., Ltd. and the respective Affiliate are responsible for the processing of your personal data as joint controllers.
